Kansas House Bill #2296 was amended to read; 1st conviction ,a madatory fine 2nd conviction, mandatory sentece of 30 days and a fine, 3rd conviction madatory sentence of 45 days and a fine. This is a supplemental bill amended to allow for prison beds to be freed up. The part I really have a question about is: The bill provides that if an 's criminal history makes the subject to presumptive imprisonment or if there is a departure that makes the subject to imprisonment, the new provisions of the bill apply and the will not be subject to other mandatory sentences. Does this mean that even if the persons criminal history put them in a presumptive imprisonment catagory, they wont have to go to prison for their first offense? And also if the effective date was July 1 2001, is that the date the law goes into effect?
