From a negative standpoint the primary problem is that this removes the function of legislation. If the judge rules that the spirit of the law is to benefit society as a whole, then that judge will be justified in doing anything howsoever. It ends up an instant dictatorship kit. Granted most judges would not try to become absolute rulers, but with no laws that bind the judge, there would be no protection from any judicial corruption.
