Before this constitution argument goes too far, I'd like to observe that the resolution isn't US specific (or even legal-system specific). IT could apply to England, soccer (and I'm a USSF Referee, retired, which could technically grant me the status of an authority on the resolution), or a multiplicity of other things.
Now on to the issue addressed. TO be specific, the Constitution is the SUPREME law of the land, from which the power of all branches of government derive. If we lived in a monarchy, saying the judges can overturn the constitution is akin to saying the minister of Justice could decide the King was to be beheaded. Not only could the King revoke his power (impeachment), but would probably behead him (overt act to bring down the government = treason, or at least conspiracy). Again, all lawyers should feel free to correct my interpretation.
