I live in Michigan.
I spoke to a lawyer (because I am ready to file) and he said that because I refinanced my house within the past 90 - that the courts will look at any 'financial' transactions such as that, that happened in the past 90 days, and void them - thus rendering my property as 'unsecured' and they would take it from me.
Is that true? If so, what is the probability of that happening?
I do qualify for a chapter 7 - my monthly payments exceed my monthly income and I am not behind on any secured debts.
They just took my only car from last Thursday to auction off to put money towards a judgement that is 'suppose' to be my ex-husband's responsibility.
I HAD to refinance or they were going to put my house into foreclosure - and, yes, I knew that I would not be able to file prior to refinancing - that is also why I refinanced.
But them taking my car, is 'forcing' me to do this before I am 'ready'.
Is there anything that I can do? Can they take my house? Can you 'drop' a bankrupcy (the correct spelling is offensive???) filing if, in the process, they tell you that they are going to take your house away from you?
PLEASE help!
